Kevin McCarthy Should be ARRESTED for Obstructing Congressional Investigation

Kevin McCarthy is not only UNFIT to be Unfit to be Speaker of the House, he should be ARRESTED for obstructing a congressional investigation by making threats to intimidate phone and social media companies that cooperated with the House select committee which investigated the Capitol riot.

The House Select Committee investigated the January 6 attack on the US Capitol requested phone records from telecommunications companies as part of its investigation. House Minority Leader Kevin McCarthy told the telecommunications companies not to comply with the Congressional requests and threatened that if they did, the GOP “would not forget it” once they are in power. This is a brazen act of obstructing a congressional investigation. The Department of Justice must address this promptly or else there likely will be more obstructive conduct by McCarty and perhaps others.

The law is clear on this matter;

1725. Protection Of Government Processes – Obstruction Of Pending Proceeding – 18 U.S.C. 1505

“Section 1505 of Title 18, United States Code, as amended by the Victim and Witness Protection Act of 1982, forbids anyone from corruptly, or by threats of force or by any threatening communication, influencing, obstructing, or impeding any pending proceeding before a department or agency of the United States, or Congress. In 1996 Congress enacted a clarifying amendment to 18 U.S.C. § 1515, which defines the term “corruptly” as used in section 1505 to mean “acting with an improper purpose, personally or by influencing another, including making a false or misleading statement, or withholding, concealing, altering, or destroying a document or other information.” False Statements Accountability Act of 1996, Pub. L. No. 104-292, §3, 110 Stat. 3459, 3460.

Section 1505 also specifically prohibits anyone from withholding, misrepresenting, removing from any place, concealing, covering up, destroying, mutilating, altering, or by other means falsifying any documentary material, answers to written interrogatories, or oral testimony that is the subject of a proper investigative demand under the Antitrust Civil Process Act, 15 U.S.C. §§ 1311-14, with the intent of avoiding, evading, preventing, or obstructing compliance, in whole or in part, with that demand”.

The fact that Kevin McCarthy hasn’t been arrested and just became Speaker of the House is more proof there’s two (2) “Justice” systems in the United States where the RICH and Politically well connected often escapes Justice & Accountability while Average Joe Citizens are prosecuted to the “Fullest Extent of the Law”.

McCarthy said in a statement posted to Twitter that letters from the January 6 panel sent to 35 social media, telecommunications and email companies “If these companies comply with the Democrat order to turn over private information, they are in violation of federal law and subject to losing their ability to operate in the United States,” he said. “If companies choose to violate federal law, a Republican majority will not forget and will hold them fully accountable”

“The Select Committee is investigating the violent attack on the Capitol and attempt to overturn the results of last year’s election,” a committee spokesperson said in a statement, responding to McCarthy’s threat. “We’ve asked companies not to destroy records that may help answer questions for the American people.
